Payment with Scalapay

If you buy with Scalapay, you'll receive your order immediately and pay in 3 installments.
You acknowledge that the installments will be assigned to Incremento SPV Srl , related parties and their assignees, and that you authorize such assignment.

Premise

The offer and sale of products on the sermonetagloves.it website are governed by these General Conditions of Sale.

The Customer is required to carefully read these General Conditions of Sale before submitting his/her Purchase Order.
Submitting a Purchase Order implies full knowledge and express acceptance of both the aforementioned General Conditions of Sale and of what is indicated in the Order Form.

Once the online purchase procedure has been completed, the Customer is also required to print and keep these General Conditions of Sale and the related Order Form, already viewed and accepted.

1. Object

These General Conditions of Sale concern the sale of products carried out online via the e-commerce service on the website www.sermonetagloves.it .

The products sold on the site can be purchased and delivered exclusively to the countries indicated in the Order Form.
Any orders for shipments outside of these countries will be automatically rejected during the Order processing process.

2. Subjects

The products are sold directly by the company Five Stars Srl , with headquarters in Via delle Carrozze, 12 – 00187 Rome (RM) , registered in the Rome Company Register under no. REA RM 1527172 , Tax Code and VAT number 14527551007 , owner of the Site (hereinafter “ Sermoneta Gloves ” or “ Seller ”).

The products are sold to the Customer identified by the data entered when completing and sending the Order Form in electronic format, with simultaneous acceptance of these General Conditions of Sale.

The offers on the website www.sermonetagloves.it are aimed exclusively at adult customers.
Minor customers must obtain the consent of a parent or legal guardian before making purchases.

By accepting the Conditions of Sale, the Customer declares to:

  • be of legal age (18 years of age or older);

  • possess the legal capacity to enter into binding contracts;

  • provide true and correct data.

The Customer releases the Seller from any liability arising from the issuance of incorrect tax documents due to errors in the data provided, as the Customer is solely responsible for their correct entry.

3. Sales via e-commerce service

The online sales contract is a distance contract having as its object the sale of movable goods between the Customer and Five Stars Srl , as Seller, via the website.

To complete the purchase, the Customer must complete the electronic Order Form and send it to the Seller following the instructions indicated.

The Order contains:

  • a reference to these General Conditions of Sale;

  • information and images of each Product with relative price;

  • available means of payment;

  • delivery methods and costs;

  • conditions for exercising the right of withdrawal;

  • methods and times for returning Products.

The contract is considered concluded when the Seller receives the Order Form and verifies its correctness.
The language of the contract is Italian and the applicable law is Italian law.

The Seller may not process orders that are incomplete, incorrect or lacking solvency guarantees, informing the Customer via email.

4. Sales prices

All Product prices and shipping costs include VAT and are expressed in Euros .
The prices are valid as indicated at the time the Order is sent.

Any customs costs or import taxes for shipments outside the EU are the responsibility of the Customer and must be paid upon delivery.

5. Payment methods

Payment can be made according to the methods indicated in the Order Form, including:

  • Credit/debit card: you will be charged only upon shipment;

  • PayPal: via an account registered at www.paypal.com ;

  • Scalapay: in 3 installments, as described at the beginning of the document.

The Seller does not store credit card data.
The Seller cannot be held liable for fraudulent use of payment instruments by third parties.

6. Shipping and delivery

Each shipment contains:

  • the Products ordered;

  • transport document/invoice;

  • any customs documentation;

  • informational or promotional material.

The Products will be delivered to the address indicated by the Customer via a courier selected by the Seller.
Upon delivery, the Customer must check the integrity of the packages and, in the event of anomalies, immediately report them to the courier and refuse the delivery.

7. Right of withdrawal and return

Pursuant to Article 64 of Legislative Decree No. 206/2005, the Customer may withdraw from the contract within 14 working days of receiving the goods, without penalty.
In case of withdrawal, the Customer must follow the instructions communicated by the Seller.

8. Warranty for non-compliant products

The Seller is responsible for any defects in conformity of the products offered.

The warranty is valid if:

  • the defect occurs within 24 months of delivery;

  • The Customer must submit a complaint within 1 month of discovering the defect, to the following address: roma@sermonetagloves.it .

The Customer has the right, free of charge, to the repair or replacement of the product, or to a price reduction or termination of the contract.
All return costs for defective products are the responsibility of the Seller.

10. Communications to the Customer

All communications and documentation relating to the purchase of the Products will be sent to the email address provided by the Customer during registration, with the option of downloading onto a durable medium.

11. Applicable law and competent court

These General Conditions of Sale are governed by Italian law .

Any disputes will be resolved:

  • from the Court of the place of domicile or residence of the Customer (if consumer);

  • from the Court of Rome (if the Client acts as a professional or company).

12. Modification and updating

The Seller may modify these General Conditions of Sale at any time.
The new conditions will be effective from the date of publication on the shop.ndsg.it website and will apply only to orders placed after that date.
